PhD scholar cleared of bribe allegation

 While absolving the research scholar who was doing his PhD in Buddhist studies, special judge B R Kedia said the prosecution also could not prove that the accused ever demanded money from the BA student, who was allegedly caught with the cheating material. 

“The accused was merely a research scholar in the department of Buddhist studies and was not even an employee of Delhi University while acting as an invigilator in the examination room on April 30, 2002,” said the judge. “I have no hesitation in concluding that the accused cannot be treated as public servant and, therefore, the penal provision under Sections 7 & 13(2) r/w 13(1) (d) (offences of related to demand of bribe and misuse of official positions) of the Prevention of Corruption Act, 1988, cannot be attracted against him.

The PhD student was booked under various provisions of the PC Act by the Delhi government’s anti-corruption branch on a complaint made by the student who was allegedly caught cheating. 
 
 The court relied on testimonies of various witnesses, including that of DU’s controller of examination in 2002, who said research scholars appointed as invigilators are not university or government employees and that their duty as an invigilator is over as soon as they hand over the answer sheets to the superintendent of examination centre. 
 
 It also relied upon the deposition of other witnesses like the centre superintendent and co-invigilators to conclude that the accused never took the BA student out of the examination hall to demand bribe.
